Terms of Service

These terms govern your use of the Klynea patient app, clinician app, and websites (together, the "Service"), operated by Klynea — a sole proprietorship registered in India (Udyam Reg. No. UDYAM-UP-50-0279489), proprietor: Asiya Hashmi ("Klynea", "we", "us"). By using the Service you agree to these terms.

Important medical disclaimer

Klynea is a software platform that supports the relationship between you and your clinicians. It is not a substitute for professional medical advice, diagnosis, or treatment, and AI features are decision-support only. Always seek the advice of a qualified clinician. In an emergency, call your local emergency number immediately — do not use the Service for urgent or life-threatening situations.

1. Eligibility & accounts

The Service is currently offered in India to invited beta participants. You must provide accurate information and keep your login credentials secure. You are responsible for activity under your account. Accounts for children or dependents must be managed by a verified parent or lawful guardian.

2. Acceptable use

You agree not to misuse the Service, including: attempting to access data you are not authorised to see; uploading unlawful or harmful content; interfering with security; reverse-engineering the platform; or using it to provide medical advice you are not licensed to give.

3. Health records & your data

Your health records remain yours. We process them as described in ourPrivacy Policy andDPDP compliance notice. You control which clinicians can access your record, and you may export or request erasure of your data subject to legal record-keeping requirements that apply to clinicians.

4. AI-assisted features

Some features use artificial intelligence to summarise, draft, or surface information. AI output can be incomplete or wrong and must be reviewed by a qualified clinician before being relied upon. Klynea is not liable for decisions made solely on AI output.

5. Beta service

The Service is in private beta and provided on an "as is" and "as available" basis. Features may change, break, or be withdrawn. We may suspend access for maintenance or to protect the platform.

6. Fees & payments

Klynea's platform features are currently provided free of charge during the beta. Consultation fees you pay to a practitioner are separate from Klynea's platform and are not fees charged by Klynea. If we introduce paid plans, we will give you clear notice of pricing and terms before any charge applies.

Direct-Transfer Payments. Where a consultation fee is settled by direct UPI transfer to a practitioner's designated virtual payment address, such payment is a bilateral transaction between the patient (remitter) and the registered practitioner (beneficiary). Klynea functions solely as a technology facilitator and is neither a party to, the payee/beneficiary of, nor a payment intermediary, aggregator, or collection agent for such transaction. Klynea does not receive, hold, route, or settle these funds. All matters concerning payment status, confirmation, reversal, refund, or dispute shall be resolved exclusively between the patient and the practitioner, and Klynea bears no liability in respect thereof.

7. Intellectual property

The Service, including its software, design, and brand, is owned by Klynea and protected by law. We grant you a limited, non-exclusive, non-transferable licence to use the Service for its intended purpose. Content you upload remains yours; you grant us the limited licence needed to operate the Service for you.

8. Limitation of liability

To the fullest extent permitted by law, Klynea is not liable for indirect, incidental, or consequential damages arising from your use of the Service. Nothing in these terms excludes liability that cannot be excluded under applicable Indian law. To the maximum extent permitted by law, Klynea's total aggregate liability arising out of or relating to the Service is limited to the greater of (a) the total fees you paid to Klynea in the twelve (12) months preceding the event giving rise to the claim, or (b) ₹10,000 (Indian Rupees ten thousand).

9. Termination

You may stop using the Service and request account closure at any time. We may suspend or terminate access if you breach these terms or where required by law. On termination, we handle your data per our retention and erasure commitments in the Privacy Policy.

10. Governing law & disputes

These terms are governed by and construed in accordance with the laws of India, and the parties submit to the exclusive jurisdiction of the competent courts in India.

11. Changes to these terms

We may update these terms as the Service evolves. Material changes will be notified in the app or by email, and the "last updated" date above will change. Continued use after changes means you accept the updated terms.
